Terms of Service

These Terms of Service (the "Terms") govern your access to and use of VorteX — the website, customer dashboard, and Discord alert feeds (together, the "Service"). By registering for, subscribing to, or using the Service, you accept these Terms in full. If you do not agree, do not use the Service.

We may update these Terms from time to time. The current version is always posted at this URL, and material changes take effect when posted. Your continued use of the Service after a change means you accept the revised Terms.

VorteX is an information service. It provides options-flow data, market alerts, and analytics for informational and educational purposes only. VorteX is not a registered broker-dealer, investment adviser, or financial planner with any federal, provincial, or state regulatory authority, and nothing in the Service constitutes legal, tax, accounting, or investment advice or a recommendation to buy, sell, or hold any security.

Trading stocks and options involves a substantial risk of loss; you may lose some, all, or more than your original investment. Past performance does not indicate future results, and no method, indicator, or signal in the Service is guaranteed to be profitable or accurate. You are solely responsible for your own research and decisions and should consult a licensed professional before investing. You trade entirely at your own risk.

VorteX delivers real-time options-flow data, market alerts, and related analytics through a web dashboard and/or as alert feeds to a Discord server. Data may be delayed, incomplete, or inaccurate, and may originate from third-party providers. We may modify, expand, or discontinue any feature, feed, or data source at any time, with or without notice.

The Service is intended for users 18 years of age or older who are capable of forming a binding contract. By using the Service you represent that you meet this requirement and that the information you provide at registration is accurate and current.

You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You may not share your password or account access with anyone. Notify us immediately of any suspected unauthorized use of your account. We may suspend or lock accounts that show signs of credential sharing or simultaneous access from multiple locations.

Paid plans are billed monthly or annually as selected at checkout, through our payment processor, Stripe. Subscriptions auto-renew at the then-current rate until cancelled. You may cancel future renewals at any time from your account dashboard or by contacting support; cancellation stops future charges but does not retroactively refund the current period.

Prices may change from time to time; any change applies to renewals after the change takes effect. Applicable sales taxes or VAT are added at checkout where required and are collected and remitted through Stripe.

Within the first 7 days of your initial subscription, you may request a full refund if the Service is non-functional. After 7 days, charges are non-refundable, but you can cancel future renewals at any time. Digital goods already delivered are not otherwise refundable.

Subject to your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service. Dashboard access is for a single individual user. A Discord feed license is tied to a single Discord server.

Except where a white-label plan explicitly permits delivery to the members of your own licensed Discord server, you may not copy, scrape, reproduce, redistribute, resell, sublicense, broadcast, or otherwise share the data, alerts, or analytics provided through the Service — including data derived from them — with any third party. You may not use automated systems to extract data, nor decompile, reverse engineer, or attempt to derive the underlying methods or algorithms. Sharing credentials or licenses, or any unauthorized redistribution, may result in immediate termination without refund.

The Service and all of its contents — software, data compilations, branding, and analytics — are owned by VorteX and/or its data providers and are protected by intellectual property laws. Your subscription grants a limited license to use the Service for your own personal or internal use only and transfers no ownership to you.

Access to any VorteX Discord community is a revocable privilege. You agree to keep conduct lawful and respectful and not to spam, harass, post unlawful or abusive content, promote competing or external paid services, or solicit other members. Nothing posted in the community is financial advice, and we do not verify the accuracy of member-posted content. We may moderate, mute, or remove any user or content at our discretion.

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or timeliness. We do not warrant that the Service will be uninterrupted or error-free; outages of upstream platforms (such as Discord, Stripe, or data providers) may prevent delivery of alerts.

To the maximum extent permitted by law, VorteX is not liable for any indirect, incidental, consequential, special, or punitive damages, or for any lost profits, lost data, missed signals, or trading losses, arising from your use of or inability to use the Service. Our aggregate liability for any claim is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless VorteX and its operators, partners, and agents from any claims, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your breach of any representation made here.

We may throttle, suspend, or terminate your access to the Service at any time for violation of these Terms, suspected abuse, or unauthorized redistribution of data. Upon termination you must cease all use of the Service and delete any stored or cached data in your possession. Users who violate these Terms may forfeit subscription charges already paid.

These Terms are governed by the laws of the Province of Québec and the laws of Canada applicable therein. Disputes shall be resolved in the courts of Montréal, Québec, unless applicable consumer-protection law requires otherwise.
